Terms and Conditions
General Use
- Dominic Turner (from this point referred to as 'The Photographer') reserves the right at all times to use the photographs for display, exhibition, competition or advertising. This use includes, but is not limited to, the following media: prints, magazines, newspapers, the internet, wedding fairs, display boards.
- The client does not, unless agreed previously in writing, hold the copyright for any of the photographs produced by The Photographer. If high resolution files are supplied by The Photographer on disk, the client has the right to print or reproduce those photographs for personal or non-profit use only, unless otherwise agreed. The client may not duplicate the files or pass them on to a third party without the express written permission of The Photographer.
- Unless previously agreed, the photographs will not be released to the client until full payment has been made to The Photographer.
- In the unlikely event of equipment failure or illness, or any other reason which prevents The Photographer carrying out the work previously agreed, The Photographer shall only be liable to refund any monies paid by the client to The Photographer. The Photographer is not liable for any loss arising from failure to complete the work, and will not be liable for consequential loss arising including but not limited to the unavailability of subjects or venues, vehicles, the effects of the weather, force majeure, or any other matters beyond the control of The Photographer.
- The Photographer is insured to an appropriate level of professional indemnity and public liability. The client is recommended to insure themselves against any areas excluded by this agreement.
- Where payment is not due prior to the agreed work being carried out by The Photographer, full payment must be made within two weeks of The Photographer presenting an invoice to the client. If payment is not made within this period The Photographer reserves the right to charge additional fees before supplying the photographs.
Portraits
- The Photographer does not undertake commissions for nude portraiture.
Weddings
- The client agrees to pay a 10% non-refundable deposit upon booking, which secures the services of The Photographer on the agreed date. This deposit will be subtracted from the total price.
- The full balance is due 1 week prior to the agreed date. The client may cancel at any time prior to the wedding, but any monies paid will not be refunded, except at The Photographer's discretion.
- The Photographer can cancel at any time prior to the wedding, and in the unlikely event that this occurs all monies (including the deposit) paid would be repaid in full to the client.
- The client must select any photographs that are included as part of their wedding package (including, but not limited to, those supplied as prints, in an album, or on disk) at some point in the six months after the event has occurred. If the photographs are not selected during this time period, The Photographer reserves the right to charge additional fees before supplying the photographs.
Commercial / Events
- Unless otherwise stated, The Photographer agrees to supply the photographs as high resolution TIFF files on disk, which the client can then use for any purpose except direct resale. This includes using the photographs in advertising and in media which will be sold for profit.
- The client does not, unless previously agreed, obtain the copyright for any of the photographs, and cannot resell them as either files or in print form unless previously agreed in writing with The Photographer. The client can sell media which includes the photographs, but only where the photographs do not comprise the sole content of that media, or a substantive part of it.
Vouchers / Promotional Offers
- Promotional offers or vouchers can never be used in conjunction with other special offers or deals.
- Portrait vouchers can only be used for portrait sittings in the Colchester, Essex area (within a 30 mile radius of Colchester). If you wish to use a voucher for a sitting beyond this area, The Photographer reserves the right to charge an extra fee for travel costs.
- Standard portrait vouchers may be redeemed against a studio portrait sitting if an extra fee of £25 is paid.
- The Photographer does not undertake commissions for nude portraiture, and vouchers cannot be redeemed against this type of work.
- Vouchers, coupons, or other special offer items will never have any monetary value. They can ONLY be redeemed against the cost of photographic services from The Photographer.
- Vouchers which have not yet been redeemed against photographic services can be returned within 30 days of purchase for a full refund of any monies paid for said vouchers.
- It is the customer's responsibility to check that the photographer is available if vouchers are bought for a specific date. If vouchers are bought and The Photographer is not available, refunds will only be available at The Photographer's discretion.
